Bill Caption

Relating to the confidential and privileged communications and records of victims of certain sexual assault offenses.

Fiscal Notes

No significant fiscal implication to the State is anticipated.

Bill Analysis

HB 1374 would strengthen the confidentiality of disclosures made by sexual assault victims to a victim advocate. In certain proceedings, survivors would have the privilege to refuse to disclose and prevent others from disclosing any confidential information. An unauthorized disclosure of a portion of information would not waive the survivor’s privilege except under certain circumstances.

Vote Recommendation Notes

Texas Action is neutral on HB 1374.
