HB 1178 would repeal the criminal offense of possession of drug paraphernalia.

Vote Recommendation Notes

Texas Action supports HB 1178 because it would promote individual liberty and limited government. Merely possessing items that could be used for the production or intake of a controlled substance does not violate anyone’s rights. Individuals who possess, grow, or sell dangerous controlled substances would still be able to be prosecuted. HB 1178 would correctly remove the threat of prosecution for possessing drug paraphernalia, itself a victimless activity.
