Relating to the requisites of a bail bond given by certain defendants and to conditions of release on bond for certain defendants.
No significant fiscal implication to the State is anticipated.
HB 1005 would require bail bonds for defendants charged with
various trafficking and prostitution charges to include the address, ID number,
and state of issuance shown on the driver’s license or ID card for the
defendant and any surety. These bonds would also have to require the defendant
not to communicate with the victim or go near their residence, workplace,
business, or school or childcare facility, if applicable. If enacted, magistrates would be
able to revoke such a bond if they find by a preponderance of the evidence that
the defendant violated one of these conditions.
Similarly, bonds given to defendants charged with
trafficking or public indecency in which the alleged victim is less than 18
years old would have to require the defendant to not communicate with the
alleged victim or go near their residence or school.
