Bill Analysis

SB 27 would allow administrative law judges or courts to award a person up to $1 million for reasonable attorney’s fees and costs incurred in defending against a frivolous regulatory action if the person prevails in the case and the judge or court finds that the action is frivolous.

Vote Recommendation Notes

Texas Action supports SB 27 for promoting the principles of limited government and individual liberty. This bill will help to ensure that frivolous regulatory actions do not place undue financial strain on the victims of those actions. This bill would disincentivize bad behavior on the part of regulators and protect the rights of individuals. We support SB 27.
