Bill Analysis

SB 2318 would prohibit a county from requiring a building permit to construct, improve, or occupy a structure used for the retail sale of seasonal goods if the structure is portable and smaller than 500 square feet.

Vote Recommendation Notes

Texas Action recommends supporting SB 2318 on the basis of limited government and free markets. While simple in scope, this bill would help alleviate the burden on small businesses that engage in the retail sale of seasonal goods to obtain a building permit; a process that can be expensive, time-consuming, and unnecessary.
