SB 2316 would amend the Health and Safety Cody to prohibit a
civil action that would arise from a prescriber, dispenser, or dispenser’s delegate’s
failure to provide adequate documentation in the Prescription Drug Database in
the event of a computer system failure. The prohibition of the civil action would exclude circumstances of
gross negligence.
In addition, the bill would create a Class A misdemeanor for a person who is licensed under the Texas State Board of Pharmacy. This person would commit an offense if there was an unauthorized disclosure of sensitive information.
The bill would provide for an administrative penalty for various instances of non-compliance with certain regulations. Compliance standards would be set and regulated under the authority of the Texas State Board of Pharmacy.
