Bill Caption

Relating to the calculation of the ad valorem taxes imposed on property for the year in which the property is acquired by a governmental entity.

Fiscal Notes

No fiscal implication to the State is anticipated.

Bill Analysis

Under current law, certain property is obtained by units of government through a Public Use Agreement (PUA).

SB 2083 would update the date used to prorate the tax due to the seller so that the seller is not responsible for taxes after effectively giving up right to use or posses the land through a PUA but before the transaction is complete.

Vote Recommendation Notes

Texas Action supports SB 2083 which protects property owners who are selling land to a government entity by ensuring that their tax liability is appropriately prorated so as not to make them liable for taxes during a time period when they should not be.
