Bill Analysis

SB 1845 would establish certain requirements for mixed-use real estate developments, particularly in relation to dedicatory instruments of certain mixed-use real estate developments in property owners associations. This bill would apply to certain mixed-use real estate developments located within Harris County in which property owners are subject to mandatory membership in a property owners association.

Vote Recommendation Notes

Texas Action recommends opposing SB 1845 as a violation of limited government and free markets. Regardless of the restrictive nature of these property owners associations, it is not the proper role of the state to interfere with these private contracts.
