Relating to the creation and use of public facilities corporations.
No fiscal implication to the State is anticipated.
Under current law, local governments are authorized to create public facilities corporations (PFC) to help facilitate providing and financing public facilities on the local government's behalf.
SB 1689 would authorize two or more sponsors to jointly establish a PFC. The bill would also authorize the transfer of funds between the sponsoring entities.
Without commenting on the underlying concept of PFCs, we do not see a liberty principle connection with the concept of allowing for joint sponsorship of PFCs and consequently remain neutral.
