Bill Analysis

SB 1428 would allow a property owner or their agent to sue their appraisal district, chief appraiser, or appraisal review board to compel those entities to comply with a procedural requirement applicable to protest. A property owner would not be able to bring suit unless the property owner delivered written notice of the procedural requirement that the entity failed to comply with, and the entity refuses to comply with the requirement on or before the 10th day after the date the notice is delivered.

Vote Recommendation Notes

Texas Action supports SB 1428 on the basis of limited government and private property rights. This bill would help ensure that taxpayers are provided with fair, unbiased hearings and a mechanism for correcting any unfair actions taken by an appraisal review board.
