Bill Analysis

SB 1363 would require drivers driving near a highway maintenance vehicle contracted by the Texas Department of Transportation or a service vehicle used in the maintenance of an electrical power line to slow down and move a lane away from the vehicle if possible. Violating this law would be a misdemeanor with further penalties possible if a violation results in bodily injury. The bill would additionally expand the definition of a highway maintenance vehicle to include equipment for road maintenance such as guard rail repair, sign maintenance, and temporary traffic control device placement or removal.

Vote Recommendation Notes

It is well within the proper scope of state government to determine the rules of the road. This legislation does not affect our liberty principles and we remain neutral.
