The bill would make no appropriation but could provide the legal basis for an appropriation of funds to implement the provisions of the bill. The Department of State Health Services is required to implement a provision of this Act only if the legislature appropriates money specifically for that purpose. If the legislature does not appropriate money specifically for that purpose, the department may, but is not required to, implement a provision of this Act using other appropriations available for that purpose.
SB 1313 would direct the Department of State Health Services (DSHS) to develop and implement a school-based demonstration program focusing on childhood obesity, as well as a chronic disease prevention demonstration program for adults in certain border counties. It also provides for DSHS to work with the appropriate medical and health education experts, as well as with state agencies.
Texas Action opposes SB 1313 because it violates the principle of limited government. This demonstration program is outside the core function of government and is a more appropriate task for medical professionals and nonprofit organizations.
