Relating to the towing of certain property from a self-service storage facility for disposition by a vehicle storage facility.

Bill Analysis

When a lessee fails to pay rent, a self-service storage facility must notify the lessee before pursuing a lien on the stored property. These facilities sometimes store vehicles, trailers, boats, and other things and must auction them when the lessee breaks the lease agreement and does not respond to notice. This bill would provide another option that would allow the facility to waive its lien rights and transfer the vehicle to a licensed vehicle storage facility.

SB 1855 would allow a lessor who takes possession of certain motor vehicles to enforce a lien to transfer possession of the property and have the property towed to a vehicle storage facility for disposition by the facility if: (1) the transfer of possession and towing is authorized under a written rental agreement; (2) the lessor gives written notice of the lessor's claim to the tenant as required under statute; (3) the tenant fails to satisfy the claim on or before the 14th day after notice is delivered; and (4) the vehicle storage facilities agrees in writing to accept the property.
