Bill Analysis

SB 1184 would allow all agents acting under powers of attorney and legal guardians, including eligible wards of court-appointed guardians, to qualify as adult beneficiaries under the Texas ABLE Program. This program allows people with disabilities to have a tax-advantaged savings account to fund disability expenses.

This clarifies existing law that allows the parent of a minor, a custodian, or other fiduciary to serve as a participant and establish a Texas ABLE account on behalf of a disabled person.

Texas Action is neutral on SB 1184 because it does not affect our liberty principles.
