HB 883 would allow courts to increase the amount of damages up to three times the actual damages in a civil action for Internet fraud if they find that the action adversely affected an elderly individual.
Texas Action remains neutral on HB 883 because it does not affect our liberty principles. We generally oppose increased penalties based on an individual's status, particularly when the harm caused applies equally to everyone. However, this bill seems to address the particular vulnerability of elderly individuals who, because of their status, are more susceptible to Internet fraud and lose approximately 10 times as much money as individuals who are younger. Considering these factors, we remain neutral on HB 883.
