Relating to behavior improvement plans and behavioral intervention plans for certain public school students and notification requirements regarding certain behavior management techniques.
No fiscal implication to the State is anticipated.
HB 873 would require schools to at least annually adjust or update a student's behavioral improvement or intervention plan to address any changes in a student's circumstances or the safety of the students or others. This bill would also require changes in district's student codes of conduct to include specifying if a student has or does not have a behavior improvement or intervention plan when notifying a parent or guardian if their child violated the code of conduct.
Additionally, school districts would be required to notify a student's parent or guardian for each use of restraint or time-out that includes the date, time, location, and nature of the restraint or time-out as well as a description of the activity in which the student was engaged with before the use of punishment, the student's behavior that prompted the punishment, and efforts made to de-escalate the situation or alternatives to restraint or time-out.
This seems to be an administrative issue and not one that would impact our principles, therefore, Texas Action remains neutral on HB 873.
