Bill Analysis

HB 790 would enable a person to recover reasonable attorney's fees from an organization, the state, or an agency or institution of the state if the claim is for: rendered services; performed labor; furnished material; freight or express overcharges; lost or damaged freight or express; killed or injured stock; a sworn account; or an oral or written contract.

Vote Recommendation Notes

Texas Action supports HB 790 because it advances the principle of property rights. If a person who has certain civil claims against an individual can recover attorney's fees from that individual, they should also be able to recover attorney's fees from the state, if the state is the party that has wronged them.
