Bill Caption

Relating to the right to vacate and avoid liability under a residential lease after a tenant's death.

Fiscal Notes

No fiscal implication to the State is anticipated.

Bill Analysis

HB 69 would allow the representative of the estate of a rental tenant who died before the expiration of the term of the lease to terminate the lease and avoid liability for the remaining term of the lease. In the event of a death, the deceased tenant's estate would still be responsible for any ‘wear and tear’ fees, but the bill would not permit the landlords to impose any penalties such as re-letting or early move out fees.

Vote Recommendation Notes

Texas Action remains neutral on HB 69 as it neither advances nor hinders our liberty principles.
