Relating to the suspension of a student who is homeless from public school.
No significant fiscal implication to the State is anticipated.
HB 692 would prohibit schools from giving a homeless student an out-of-school suspension. The bill would allow schools to work with the school district's homeless education liaison to come up with alternative punishments for these students.
The Senate committee substitute would provide exceptions to this prohibition if the student engaged in: (1) conduct that contains the elements of an offense related to weapons under certain sections of the Penal Code; (2) conduct that contains the elements of a violent offense under certain sections of the Penal Code; or (3) selling, giving, or delivering to another person or possessing, using, or being under the influence of certain defined drugs or alcohol.
While this is probably good public policy, the provisions of this bill do not appear to have a connection to our liberty principles and we remain neutral on HB 692.
