Bill Analysis

HB 566 would allow a defendant charged with multiple offenses arising out of the same criminal episode to petition the court for an order of nondisclosure of criminal history provided certain conditions are met. The purpose of this bill is to ensure that such a person does not appear to have a more significant criminal record than they actually do in the event that some of the charges have been acquitted, dismissed, or reduced.

Vote Recommendation Notes

Texas Action supports HB 566 because it supports the principles of personal responsibility and limited government. In cases where the court grants this nondisclosure under the provisions of this bill, a defendant would be more able to fully participate all facets of society and the economy, have a better chance of rehabilitation, and be less likely to re-offend.
