HB 558 would allow courts to designate special needs trusts as recipients of child support for a special needs child. This bill would require the involvement of both parents and would not apply to a Title IV-D case.
The purpose of this bill is to prevent child support payments for special needs children who are recipients of certain disability benefits such as Supplemental Security Income (SSI) which is conditioned in part on the recipient remaining below a certain income threshold. This bill would keep child support payments from counting against that threshold.
