According to the Legislative Budget Board, no fiscal implication to the state is anticipated.

Bill Analysis

Current statute requires the Health and Human Services Commission, in consultation with the commissioner of education, to "adopt rules regarding the maintenance, administration, and disposal of an epinephrine auto-injector." The law also requires the commissioner of education to be included on reports of any use of an epinephrine auto-injector in a primary or secondary school.

HB 3881 would remove the commissioner of education from these requirements and leave the adoption of rules and receiving of reports within the domain of the commissioner of state health services.
