Bill Analysis

HB 3815 would require a separate notification of disclosure to be added to real estate transactions by the seller in order to notify the purchaser if the property was located in a flood plain.

Vote Recommendation Notes

Texas Action recommends opposing HB 3815 as a violation of limited government and personal responsibility. Disclosure of flood plains is already listed as a disclosure to buyers by law. This bill would not only result in a duplicative process, but it would also unnecessarily expand state government.
