Bill Analysis

HB 3809 would increase the statute of limitations for bringing a civil action related to sexual assault of a child, aggravated sexual assault of a child or continuous sexual abuse of a child from 15 to 30 years. 

Vote Recommendation Notes

Texas Action is neutral on HB 3809 as it does not appear to have a connection to our liberty principles. Statutes of limitations are important because they help protect people from being subject to civil or criminal penalties for long-ago offenses that are difficult if not impossible to substantiate. We do not have a basis to determine whether the increased statute of limitations proposed by this bill is appropriate so we remain cautiously neutral.
