Relating to the consideration of ownership interests of certain
persons with a disability in determining whether a business is a
historically underutilized business for purposes of state
contracting.
No significant fiscal implication to the State is anticipated.
HB 3362 would seek to define persons with disabilities as "economically disadvantaged persons" for the purpose of increasing the amount of state contracts awarded to businesses that are at least 51% owned by persons with disabilities. Disabled business owners would need to submit to the Comptroller an affidavit from a Texas licensed physician verifying that owner’s disability in order to qualify as a historically underutilized business for purposes of the bill.
Texas Action is opposed to HB 3362 because it violates our principles of limited government, free market, and personal responsibility. This bill would create special economic advantages for a preferred class of individuals. We are opposed to policy that favors one class over others and believe that tax policy should be broad based, low rate, and equitable to all. For these reasons, we oppose HB 3362.
