Fiscal Notes

Estimated Two-year Net Impact to General Revenue Related Funds for HB 3224, As Introduced: an impact of $0 through the biennium ending August 31, 2021; however, there are costs associated with General Revenue-Dedicated Hazardous and Solid Waste Remediation Account No. 550.

The bill would make no appropriation but could provide the legal basis for an appropriation of funds to implement the provisions of the bill.

Bill Analysis

HB 3224 would amend the Health and Safety Code by creating a defense from liability for those who arrange for the recycling of certain metals to recycling facilities which later go on to cause pollution with those materials. Such a person would not be liable under the Solid Waste Disposal Act if they are able to establish with a preponderance of the evidence that they would not be held liable under federal law (42 U.S.C Section 9607(a)(3) or (4)).

Vote Recommendation Notes

Texas Action supports HB 3224 as it uplifts our principles of limited government, property rights and individual liberty. This bill would effectively reduce frivolous lawsuits and protect individuals from being held liable for actions that were not their own.
