Relating to the prosecution of the offense of continuous sexual abuse of a child or disabled individual.
The probable fiscal impact of implementing the bill is indeterminate due to a lack of data
that would allow those cases in which the victim of the sexual abuse was a disabled individual
to be isolated from all other sexual abuse cases. These data are necessary to determine the
number of individuals who would be eligible for prosecution under the proposed continuous
sexual abuse of a child or disabled individual offense and the fiscal implications of the bill's
provisions.
HB 3177 would create the offense of continuous sexual abuse of a young child or disabled individual by expanding the applicability of conduct constituting the offense of continuous sexual abuse of a young child or children to include disabled individuals. This bill includes any knowing act of: (1) compelling prostitution; (2) trafficking another person and, through force, fraud, or coercion, causing that person to engage in prostitution, promotion of prostitution, aggravated promotion of prostitution, or compelling prostitution; and (3) receiving a benefit from participating in a venture that involves such engagement or engaging in sexual conduct with a person trafficked in such a manner.
Texas Action is neutral on HB 3177 as it does not affect our liberty principles.
