Relating to the classification and operation of mopeds and certain
motorcycles.
No significant fiscal implication to the State is anticipated.
HB 3171 would make a variety of changes to laws regarding mopeds. The bill would repeal the moped license and remove mopeds from the Class M driver's license classification, allowing anybody with a driver's license to operate a moped without the need for any special classification.
Additionally, the bill would make statutory changes in order to align certain regulations for mopeds with those of motorcycles 250cc or less. The bill would also allow a person under 18 to operate a moped after midnight and before 5 a.m. if the person is in sight of the person’s parent or guardian.
Lastly, the bill would allow mopeds to have LED lighting on its underbody and would institute a host of other statutory changes to exempt mopeds from Transportation Code laws that currently apply to them.
Texas Action supports this bill for promoting the principles of individual liberty, property rights and limited government. This bill would introduce a host of changes that would give moped drivers more freedom in driving their vehicle of choice without undue government interference or prohibition.
