Bill Analysis

HB 304 would change the nature of the signatures required for a petition requesting the creation of a municipal management district (MMD) from the signatures of the owners of a majority of the assessed value of the real property in the proposed district, to the signatures of the owners of a majority of the assessed value of such property that would be subject to assessment by the district. It would also remove residency as a qualification for serving as a district director, and allow for appointment. Additionally, this bill would authorize owners of property subject to assessment by a district to recommend to the governing body of the applicable municipality persons to serve on a succeeding board of directors of the MMD.

Vote Recommendation Notes

Texas Action recommends supporting HB 304 because it would strengthen the property rights and individual liberty of individuals subject to taxation through an MMD. It would also give them more of a voice in who serves on the board of an entity which taxes those individuals.
