Relating to the service of notice of a special commissioners' hearing in an eminent domain proceeding.

Bill Analysis

HB 2831 would update the property code relating to the process of serving notice in an eminent domain case. This bill would simplify and expand the notice requirement by requiring that the notice be delivered in person or in another manner provided by the Texas Rules of Civil Procedure for service of citation.

Vote Recommendation Notes

HB 2831 is a procedural bill which does not appear to affect our liberty principles and we remain neutral. We do note that this bill, which addresses a controversial issue, appears to enjoy broad support from condemning entities and property rights supporters alike and does not appear to be a controversial bill.
