Bill Analysis

HB 2792 would require a person "knowingly" make a false statement or false representation in an application for a permit or license filed with the Texas Alcoholic Beverage Commission in order for that false statement or representation to constitute a punishable offense. Adding the word "knowingly" to the statute prevents a person from being punished for an innocent mistake.

Texas Action supports HB 2792 for promoting the principles of limited government and individual liberty. The punishment for making a false statement on an alcoholic beverage permit/license application is quite severe, punishable by imprisonment of not less than two years and not more than 10. This bill will help to ensure that Texans are not prosecuted and imprisoned for true accidents or mistakes.
