HB 2782 would make numerous changes to state law related to probate matters. Among other things, these changes include the following: (1) requiring a contracting third party to provide a personal representative all information that would have been provided to the deceased upon request; (2) voiding an otherwise valid transfer on death deed as to any real property conveyed during the transferor's lifetime after the deed is executed and recorded unless a memorandum sufficient to give notice is also recorded; (3) with respect to community estates, specifying that the deceased spouse's undivided one-half interest passes to children or other descendants; and (4) specifying that testimony in a proceeding to declare heirship must be taken from two disinterested and credible witnesses (unless a diligent search was made and only one such witness can be found).
