Bill Analysis

HB 2757 would provide that for any action governed by the laws of this state concerning rights and obligations under the law, the American Law Institute’s Restatements of the Law are not controlling.

Vote Recommendation Notes

Texas Action supports HB 2757 as it advances the principle of individual liberty. This bill would prevent misuse of the American Law Institute's Restatements in state courts by establishing that such Restatements are not controlling in any action governed by state law. These Restatements are not binding authority and should be used only as a secondary authority when the court finds it necessary.
