Bill Analysis

Under current law, a person with an insurance policy through the Texas Windstorm Insurance Agency may only bring a legal action for denial of a claim under certain circumstances. The only issues a claimant may raise are whether the denial of coverage was proper and the amount of damages to which the claimant is entitled, if any.

HB 2686 would amend the Insurance Code by allowing a claimant who was denied their claim in whole or in part to continue an action against TWIA, regardles of whether TWIA later accepts claim.

HB 2686 is procedural in nature without an apparent connection to our liberty principles. For these reasons we remain neutral.
