Bill Analysis

HB 2559 would require (rather than allow) the Pardons and Paroles division to issue a summons rather than an arrest warrant to a person charged with violating a condition of parole or mandatory supervision in certain circumstances. The bill would prevent the court from issuing a warrant for the return of a releasee covered by this bill unless they have previously failed to appear for a hearing in response to a summons issued. 

Vote Recommendation Notes

We generally support alternatives to arrest for minor violations of the terms of parole or mandatory supervision but we are concerned that taking away discretion as this bill does may have unintended adverse consequences, including making law enforcement more difficult than necessary. For these reasons we remain neutral on HB 2559.
