HB 2547 would allow the chief justice of the supreme court to assign a qualified former justice or judge of the supreme court, of the court of criminal appeals, or of a court of appeals to a court of appeals for active service as a visiting judge or justice. This bill would decrease the minimum number of months a retired or former justice or judge has served to be eligible for assignment from 96 months to 72 months. The retired or former justice or judge must not have been removed from office for certain misconduct or incapacity.
Texas Action supports HB 2547 because it promotes limited government. A legitimate function of a limited government is maintaining the efficiency of the judicial system, and this bill would help accomplish this goal by expanding the pool of eligible visiting judges.
