Bill Caption

Relating to the designation of a property as a historic landmark by a municipality.

Fiscal Notes

No fiscal implication to the State is anticipated.

Bill Analysis

HB 2496 would prohibit a municipality from designating an area as a historic landmark without the property owner's consent or a 3/4ths vote of the governing body of the municipality and the zoning, planning, or historical commission of the city. A municipality would be required to allow a property owner to withdraw consent at any time during the designation process.

Vote Recommendation Notes

This bill would give property owners a say in whether or not their property receives a historic landmark designation. Texas Action recommends supporting HB 2496 because it promotes our principles of limited government and property rights.
