construction of residential or commercial structures.
No significant fiscal implication to the State is anticipated.
HB 2439 would prohibit a governmental entity from banning the use of a building material, product or method in the construction, renovation, maintenance, or other alteration of a residential or commercial structure if it has been approved for use by a national model code published within the last three cycles that applies to the construction, renovation, maintenance, or other alteration of the building. A government entity would also be prohibited from adopting standards more stringent than the standards in a relevant national model code published within the last three cycles.
A number of specific enumerated exceptions would apply.
Texas Action supports HB 2439 for promoting the principles of limited government and free markets. This bill would help to ensure that local governments do not adopt building codes that are unnecessarily restrictive and drive up costs of construction. This bill would remove unnecessary government interference from the free marketplace.
