Bill Analysis

HB 234 would prohibit local governments and public health authorities from enforcing an ordinance that would regulate individuals that are younger than 18 years old from temporarily selling nonalcoholic beverages from a stand on private property.    

Vote Recommendation Notes

Texas Action recommends supporting HB 234 because it promotes our principles of free markets, private property rights, and individual liberty, and limited government. HB 234 would allow children and teenagers the ability to raise money and sell beverages from their home or another private property without having to go through any government bureaucracy. While a lemonade stand is the smallest of small businesses, removing barriers for children who want to sell lemonade or tea at their home promotes free market principles. This protects private property rights for parents whose kids may want to operate a lemonade stand on their property without any government regulation. HB 234 gives children the liberty to raise money for themselves and gets government out of the way.
