Bill Analysis

HB 2303 would alter the definition of a bet in the Penal Code to exclude fantasy sports competitions, as long as the outcome of the competitions are determined based on statistical performances of athletes and not based solely on the score, point spread, or performance of a single athlete. This bill essentially decriminalizes fantasy sports competitions that award a prize to the winner.

Vote Recommendation Notes

Texas Action supports HB 2303 for promoting the principles of limited government, individual liberty and free markets.  Fantasy sports competition between private individuals, including those that award prizes to the winners, should not be subject to criminal penalties in Texas.
