HB 2302 would expand a prohibition against the enforcement by a property owners' association of a restrictive covenant that prohibits a property owner or resident from displaying or affixing certain religious items on the entry of a dwelling to apply to a provision in any dedicatory instrument, and to include items displayed or affixed on the owner or resident's property.
However, this bill would authorize a property owners' association to enforce a provision of a dedicatory instrument that limits the display: (1) of a religious item to 30 days based on specified physical characteristics, certain violations regarding location or maintenance, or lack of prior approval under certain circumstances; or (2) for a religious event or holiday of a religious item otherwise subject to the 30-day limit to a specified period surrounding the event or holiday.
Texas Action supports HB 2302 because it promotes limited government, property rights, and individual liberty principles. This bill would help protect individuals against extreme overreach by property owners' associations, and provide additional freedom to utilize their property as they wish, including to display religious items.
