Bill Analysis

HB 2260 would allow a justice of the peace to issue a warrant for a blood sample for certain intoxication offenses if a magistrate is unavailable and unreachable or exigent circumstances exist.

Vote Recommendation Notes

Texas Action is neutral on HB 2260 which is a procedural bill with no affect on our liberty principles. The same rules for issuance of a warrant would apply to a justice of the peace as to a magistrate whose duty it regularly is to issue such a warrant.
