Relating to the informal dispute resolution process for certain disputes between the Health and Human Services Commission and long-term care facilities.
According to the Legislative Budget Board, no fiscal impact to the state is anticipated.
HB 2205 would require that as part of the informal dispute resolution process between the Health and Human Services Commission and long-term care facilities, the surveyor who conducted the survey that is the subject of the dispute be available to clarify or answer questions. The bill would also require the commission's review of the institution's or facility's informal dispute resolution request to be conducted by a registered nurse with long-term care experience for a standard of care violation.
If an inspection, survey, or investigation identifies a violation that constitutes an immediate jeopardy to the health and safety of a resident, the commission must immediately notify the facility's management of the violation and require a commission representative to remain in or be accessible to the facility until the commission has received the facility's plan of removal related to the violation.
