Bill Caption

Relating to the eligibility of a first responder for workers' compensation benefits for post-traumatic stress disorder.

Fiscal Notes

No significant fiscal implication to the State is anticipated.

Bill Analysis

Under current law, first responders are eligible for certain workers compensation benefits due to work-connected post-traumatic stress disorder caused by an event occurring in the course and scope of employment. This bill would add language to specify that a person is eligible if the PTSD is a result of one or more events occurring in the course and scope of the first responder's employment. It would also add that PTSD is a compensable injury if it is based on a diagnosis that the preponderance of the evidence indivates that, if not for the event, the disorder would not have occurred. The date of injury for PTSD suffered by a first responder would be the date on which the first responder first knew or should have known that the disorder may be related to the first responder's employment.

Vote Recommendation Notes

This bill has no apparent connection to our liberty principles and we remain neutral.
