Bill Analysis

HB 2003 would prevent a public agency with the power to own or operate waste collection, transportation, treatment, or disposal facilities or systems, from entering into a contingency fee contract for legal services without review and approval by the attorney general. This would not apply to (1) a contingent fee contract to collect delinquent ad valorem taxes, and court fines and fees, accounts receivable; (2) a contingent fee contract for services rendered in connection with the issuance of a public security; or (3) a type of contingent fee contract designated by the attorney general by rule based on the insignificance of the risk involved or the existence of statutory authority for the contract.
