Relating to replacement cost coverage in policies issued by the Texas Windstorm Insurance Association.

Bill Analysis

Currently, replacement cost coverage eligibility for the Texas Windstorm Insurance Association (TWIA) is determined at the time of loss.

HB 1900 would provide that if, on the effective date of a TWIA policy, the total amount of insurance applicable to a dwelling is 80 percent or more of the full replacement cost of the dwelling, or equal to the maximum amount of insurance otherwise available through TWIA, then coverage is extended to include the full cost of repair or replacement, without a deduction for depreciation. 

HB 1900 would also allow a claimant whose TWIA policy includes replacement cost coverage for the claim to request the replacement cost payment by submitting documentation of the cost and completion of repairs within 545 days of receiving notification from TWIA that coverage was accepted. This bill also amends various provisions related to appraisal deadlines and disputes.

Finally, this bill would authorize the commission of insurance to extend any deadline related to settlement and dispute resolution. However, it would prohibit the extension of deadlines related to claims arising from a particular storm from exceeding 120 days in the aggregate for deadlines applicable only to TWIA.
