Bill Analysis

HB 1849 would create a new authorization and establish requirements for physicians (or persons with prescriptive authority) to prescribe epinephrine auto-injectors in the name of day-care centers. Also, HB 1849 would require the prescribing physician or other person to provide the day-care center with a standing order for the administration of the epinephrine auto-injector for a person experiencing anaphylaxis. Liability for daycare workers acting in good faith to use or not use an epinephrine auto-injector would be limited provided certain conditions are met. 

Vote Recommendation Notes

This bill would support limited government, individual liberty, and personal responsibility by providing a legal framework to allow for this life-saving medical device to be stored and deployed at daycare facilities. We support HB 1849.
