Relating to the creation of the criminal offense of false report of misconduct by emergency responders.

Fiscal Notes

No significant fiscal implication to the State is anticipated.

Bill Analysis

HB 1625 would create the Class A misdemeanor offense of False Report of Misconduct by Emergency Responders. A person would commit this offense if with the intent to deceive, they knowingly make a false report that a peace officer or emergency services personnel, while performing official duties, engaged in conduct that violates a state law and makes the report to any law enforcement agency for the purpose of initiating a criminal investigation against the officer.

Vote Recommendation Notes

Making a false report with the intent of triggering an investigation is a serious crime. This bill creates a penalty that is commensurate with the crime and appropriately has strong mens rea protection requiring criminal intent in order to convict a defendant. We support HB 1625.
