Bill Analysis

HB 1542 would prohibit a design-build contractor selected for a contract for a highway project from making changes to companies or entities identified as part of the design-build team in a response to a request for proposal. Exceptions are provided for such as if an entity is no longer in business, voluntarily removes itself from the team, etc. If a design-build contractor makes changes in violation of the provisions of this bill, any cost savings resulting from the changes accrue to the department and not to the design-build contractor.

Vote Recommendation Notes

The terms of state contracts are within the legitimate domain of the legislature to determine and this is a policy decision for the legislature which has no apparent connection to our liberty principles, therefore we remain neutral on HB 1542.
