HB 1348 would amend the Texas Insurance Code, that concerns the “Limitation on Parts, Products, or Repair Persons or Facilities Prohibited.”
The bill would prohibit an automobile insurer from limiting coverage under a policy covering damage to a motor vehicle based on the use of a particular repair person or facility. This would also apply to settling a liability claim by a third party against an insured for property damage.
This bill violates our free market and limited government principles by prohibiting automobile insurers from using standard industry practices that help to control costs for themselves and for their customers. It is not the proper role of government to regulate the provisions of private agreements between insurance companies and their customers. For these reasons, we oppose HB 1348.
